Sarasota Bond Reduction Attorney - What is a bond reduction?

If a person is stuck in jail because he or she cannot afford a bond, an attorney can schedule a bond reduction hearing with the judge assigned to the case. At a bond reduction hearing the judge will be asked to reconsider the bond that has been set, and lower it to an amount the defendant can afford to pay. It may also be possible to ask for a non-monetary condition such as ROR (where a defendant is released without having to post a monetary bond) or SPR (where a defendant is released with various conditions imposed by the judge, such as random urinalysis or scheduled reporting). Sometimes a judge will order a combination of a monetary bond and SPR.

What are some things that a judge may consider at a bond reduction hearing?

At a bond reduction hearing the defense attorney will have the opportunity to bring to the judge's attention issues that the judge is likely not yet aware of. For instance, if the defendant is not a flight risk (is not going to run) and has substantial ties to the community (a job, family in the area, owns a home) the judge can consider these in deciding whether to reduce bond. A judge may also consider whether the defendant poses a risk to the community. For instance, the defense attorney may illicit information that the defendant is non-violent, that the defendant has minimal criminal history, and/or that there was no victim injury noted in the police report.
